Gordon Lawsuit Dismissed
A Cook County Circuit Court judge Friday dismissed the complaint brought by Don Gordon over his loss to Joe Moore in the April 17 election for 49th Ward Alderman.
Circuit Court Judge Marsha Hayes tossed out Gordon’s lawsuit alleging voter fraud because his complaint failed to set forth any specific acts of fraud. Judge Hayes also expressed serious doubt she would ever grant Gordon’s request to disregard the results in 22 precincts, which would have disenfranchised thousands of 49th Ward voters.
In an earlier ruling, Judge Hayes dismissed one of the two remaining counts in Gordon’s lawsuit and all of the plaintiffs except for Gordon himself. However, she allowed Gordon to pursue his election fraud allegations.
In Friday’s ruling, Judge Hayes stated she had reviewed the case and decided she had made a mistake. According to Judge Hayes, Gordon’s failure to allege any specific acts of fraud and the draconian remedy he requested were fatal to his election fraud claim.
“I’m pleased we are finally able to put the aldermanic election behind us,” said Ald. Joe Moore. “I look forward to working with Don and his supporters to bring our community together and tackle the many challenges that are before us,” Moore added.
